Welcome to FlashJobs. These Terms of Service ("Terms") govern your use of the FlashJobs mobile application and related services (collectively, the "Service") operated by FlashJobs, Inc., a Delaware corporation ("Company", "we", "us", or "our").
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.
1. Eligibility
You must be at least 16 years old to use FlashJobs. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
2. Account Registration
To access certain features of the Service, you must register for an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Maintain the security of your password and account
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
3. Nature of Service
FlashJobs is a platform that connects businesses ("Clients") with independent workers ("Workers") for short-term, flexible work opportunities. FlashJobs acts solely as an intermediary and is not a party to any agreement between Clients and Workers.
Workers using FlashJobs are independent contractors, not employees of FlashJobs or the Clients. Workers are responsible for their own taxes, insurance, and compliance with applicable laws.
FlashJobs does not conduct background checks on Workers or Clients, and does not verify or guarantee the identity, qualifications, licensing, or performance of any user, or the accuracy of any listing. You are responsible for exercising your own judgment before accepting a shift or engaging a Worker. FlashJobs does not guarantee that Workers will find shifts or that Clients will find Workers.
4. Worker Responsibilities
As a Worker, you agree to:
- Complete accepted jobs professionally and on time
- Communicate promptly with Clients regarding job details
- Comply with all applicable laws and regulations
- Maintain any required licenses, permits, or certifications
- Not discriminate against Clients based on protected characteristics
- Not engage in any fraudulent, illegal, or harmful activities
5. Client Responsibilities
As a Client, you agree to:
- Provide accurate job descriptions and requirements
- Provide a safe working environment for Workers
- Pay Workers directly and promptly for completed shifts, using the agreed payment method
- Treat Workers with respect and professionalism
- Not request Workers to perform illegal or unsafe activities
- Comply with all laws that apply to engaging persons under 18, including restrictions on working hours and night work
6. Payments and Fees
Businesses pay Workers directly for completed shifts, outside the app, using the payment method shown on the shift listing. FlashJobs does not process, hold, or take a share of these payments. FlashJobs charges Businesses a subscription fee to use the platform, purchased through Apple's App Store or Google Play; this fee is separate from Worker pay, and Workers are never charged a fee. See "How Payment Works" for details.
Because payment passes directly between Client and Worker, any failure to pay, underpayment, or payment dispute is a matter between the Client and the Worker. FlashJobs may assist with communication and may take account-level action against a Client who fails to pay, but is not responsible for collecting or guaranteeing payment.
7. Cancellations
Jobs may be cancelled according to the cancellation policies displayed when accepting a job. Excessive cancellations may affect your account standing and ability to use the Service.
8. Reviews and Ratings
Both Workers and Clients may leave reviews and ratings after job completion. Reviews must be honest, accurate, and not contain offensive content. FlashJobs reserves the right to remove reviews that violate these guidelines.
9. Prohibited Conduct
You agree not to:
- Use the Service for any illegal purpose
- Harass, abuse, or harm another person
- Impersonate any person or entity
- Interfere with or disrupt the Service
- Attempt to gain unauthorized access to any part of the Service
- Use automated means to access the Service without permission
- Create multiple accounts to circumvent restrictions
- Post or send offensive, threatening, or sexually explicit content
There is no tolerance for objectionable content or abusive behaviour on FlashJobs. You can report a message or a person from your conversation with them, or from their profile, and you can block anyone at any time — blocking stops all messages between you in both directions, while the conversation you already had stays where it is.
We review every report within 24 hours. Accounts found to have posted objectionable content or abused another person may be suspended or removed without notice.
10. Intellectual Property
The Service and its original content, features, and functionality are owned by FlashJobs and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. FlashJobs does not warrant that the Service will be uninterrupted, secure, or error-free. Nothing in this section limits rights that cannot be excluded under the mandatory laws of Malaysia.
12. Limitation of Liability
To the maximum extent permitted by law, FlashJobs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your use or inability to use the Service
- Any conduct or content of any third party on the Service
- Unauthorized access, use, or alteration of your transmissions or content
- Any disputes between Workers and Clients
13. Indemnification
You agree to defend, indemnify, and hold harmless FlashJobs and its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service or violation of these Terms.
14. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease.
15. Dispute Resolution
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Nothing in these Terms limits any rights or protections you have under the mandatory laws of Malaysia, including Malaysian consumer protection law, and nothing prevents you from bringing a claim in the courts of your place of residence where that right cannot be excluded.
16. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. By continuing to use the Service after revisions become effective, you agree to be bound by the revised Terms.
